Furthermore EasyWill cannot be held liable for:
  • any damages, whether direct, indirect, special, incidental, or consequential, whatsoever or for any other consequences resulting from the inclusion of any inaccurate information that was provided for the drafting thereof.
  • any damages, whether direct, indirect, special, incidental, or consequential, whatsoever resulting form the use of the Service
  • the alteration of any Last Will and Testament, or copies thereof in any way whatsoever either before or after the signing thereof.
  • the correctness of the signing format thereof, should Easywill not have verified it.
Our service to you is to provide a limited license to make use of the Interactive content on the only and not to supervise the signing and witnessing of the Will or to take responsibility for the Will being correctly signed, witnessed and dated. The services is also not drafting the Last Will and Testament but merely providing a limited license to make use of the content, including the interactive content of the website, and shall not constitute to be directly or indirectly drafting Last will and Testaments.


4. Linking to this Web Site



You may provide links only to the homepage of this Web Site, provided (a) you do not remove or obscure, by framing or otherwise, any portion of the homepage, including its advertisements, the terms of use, the copyright notice, or other notices on this Web Site, (b) you give Provider notice of such link by sending an e-mail to info@easywill.co.za and (c) you discontinue providing links to this Web Site if requested by Provider.


5. License of Your Content to Provider



By posting, publishing, uploading, or distributing any messages, data, information, text, graphics, links, content, or other materials (collectively, “Postings”) for use on this Web Site, you grant (or warrant that the owner of such rights has expressly granted) Provider a perpetual, worldwide, royalty-free, irrevocable, non-exclusive right and license, with the right to sublicense, to use, reproduce, modify, adapt, publish, publicly perform, publicly display, digitally display and digitally perform, translate, create derivative works from and distribute such Postings or incorporate such Postings into any form, medium, or technology now known or later developed throughout the universe. Provider reserves the right to investigate complaints or reported violations of our Terms of Use and to take any action we deem appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.


18. Remedies for Violations



Provider reserves the right to seek all remedies available at law and in equity for violations of these Terms of Use, including but not limited to the right to block access from a particular internet address to this Web Site and any other Provider web sites and their features.


19. Governing Law and Jurisdiction



The Terms of Use are governed by and construed in accordance with the laws of the South Africa. Any dispute arising out of or relating to these terms shall be submitted to mediation, each of the parties choosing one mediator and the third mediator being chosen by the other two mediators.


20. Privacy



Provider does not give away any information regarding its clients and keeps confidential all information received about or in connection with its clients. 21. Privacy in the case of casual surfing
